Everyone Deserves Protection From Corporate Fraud
We may not think of it when we walk into a store or purchase a product online, but we are all consumers. Everything we buy, from services to products, is manufactured or distributed by corporations or entities that have strict legal obligations to their customers. When making a purchase, we trust these corporations to provide a safe, effective and reliable product or service. Personal injuries or even death may result when these corporations fail us. In some situations involving warranties, installation contracts and service agreements, we can suffer substantial financial damages if the corporation fails to meet its obligations.

Humphrey, Farrington & McClain has secured financial reimbursement for thousands of individuals who have been financially harmed by a product or service. Many of these cases are handled through a legal procedure called a class action.
A Recent Consumer Protection Case
Most recently, our Kansas City consumer protection lawyers were able to obtain a nationwide settlement involving a water heater part called a "dip tube." The dip tube is a plastic tube that delivers cold water to the bottom of the water heater, where it is then heated. One company manufactured dip tubes for numerous water heater companies. Unfortunately, a significant number of these dip tubes, which were manufactured for a certain period of time, were found to be defective. The defective dip tube can disintegrate, reducing the amount of hot water in the home and, in some cases, depositing plastic chips throughout the plumbing system. The dip tube class action allows consumers to have defective dip tubes replaced and, if necessary, their plumbing systems flushed.
The dip tube settlement is just one example of the consumer protection cases that Humphrey, Farrington & McClain has undertaken.
Other examples include:
- Deceptive and misleading solicitations and advertising
- Failure to honor a warranty or service agreement
- Consumer antitrust litigation
- Securities fraud
- ERISA benefits actions
- Toxic tort litigation, environmental exposure
